Neste trabalho, mostramos como o regime Vargas organizou-se de uma forma dual: de um lado, oestado normativo; de outro, o estado de prerrogativas representado pela ação da polícia e doscírculos de poder. Contribuindo para o aumento e a concentração de poder estava a nova tradiçãode justiça criminal: a substituição da Escola Clássica de Direito pela Escola Positiva de Direito.Neste particular, a transmutação foi muito importante não apenas para a maneira como o sistemaprisional deveria funcionar, mas igualmente porque a polícia poderia agora trabalhar de maneiradiversa tanto no que diz respeito aos crimes comuns quanto aos crimes políticos.

Resumo Inglês:
In this research paper we show how Vargas' Regime was able to be organized in a dual way: in one hand, the normative state; in the other, the state of prerogatives represented by the police action and the government power circle. Contributing to this increase of power was the new Brazilian tradition on criminal law: the replacement of the Classical School of law for the Positive School of law. In this particular way, the transmutation was very important not only related to how the prison system should be ruled but also because police could now work in a different way in common and political crimes.
