Este artigo se propõe a fazer um esboço das relações entre a afirmação constitucional do direito à educação e as práticas decorrentes dessa afirmativa nas constituições brasileiras de 1824 e 1891, percorrendo a história da educação da Monarquia à República. A parte final arrisca-se a um debate sobre o legado educacional da Primeira República, que à luz da observação de AnÃsio Teixeira, se preocupou mais com a qualidade da educação pública do que com a sua extensão à s diversas camadas da sociedade.
Resumo Inglês:
The aim of this article is to delineate the relations between the assertion of the constitutional right to education and the practices orginated by such a statement, in the Brazilian constitutions of 1824 and 1891, tracing the history of education from monarchy to the republican regime. It also tries, at the end, to debate the educational legacy of the First Republic, which, according to AnÃsio Teixeira, more concerned with the quality of the public education than with its extension to the various strata of society.
