Este estudo tem por objeto o exame de algumas inovações disruptivas na medicina, notadamente a epigenética, a inteligência artificial (IA) e a telemedicina, sob uma perspectiva humanista, justificada nas bases axiológicas do Direito. Fez-se um panorama dos principais avanços científico-tecnológicos no campo da medicina, e, sem descuidar da sua importância para a sociedade, procurou-se demonstrar como tais progressos podem se revelar perigosos para a preservação de dados pessoais e a garantias, como a intimidade e a privacidade. Por fim, diante da necessária incidência do Direito sobre as relações interpessoais e do papel centralizador da dignidade da pessoa humana, justificou-se o atributo da empatia nas relações médico-cliente como traço insubstituível ante qualquer mecanismo de inteligência artificial (IA) ou tecnológico.

This paper aims to examine some groundbreaking innovations in the medicine field, notably epigenetics, Artificial lntelligence (AI) and telemedicine, from a humanistic perspectíve, justified on the axiological bases of the legal sciente. An overview of the main scientific and technological advances in the medicine area was made, and,witro,ut neglecting their overall importance for society, there was also an effort to demonstrate how such progress can prove dangerous for the preservation of personal data and, also, individual guarantees, such as intimacy and privacy. Finally, taking into account the mandatory rule of law in all interpersonal relationships as well as the centralizing role of human dignity, it was possible to justify the use of empathy attribute in doctor-client relationships as an irreplaceable trait facing any Artificial lntelligence (AI) or technological mechanisms.
