DIREITO E LITERATURA EM HANNAH ARENDT E “O LEITOR”

Com o advento de um pensamento crítico no Direito, permite-se uma abertura a outras áreas do conhecimento, como a Literatura. Diante disso, propõe-se, neste artigo, analisar as possibilidades trazidas pela relação jusliterária, tendo em vista que a Literatura tem a potencialidade de desenvolvimento de um pensamento crítico, bem como da sensibilização de juristas. Para tanto, parte-se do pensamento dos pesquisadores brasileiros André Karam Trindade e Lênio Streck, e da relação entre a obra “O Leitor”, de Bernhard Schlink, e a filosofia jurídica de Hannah Arendt, notadamente no tocante à banalidade do mal, presente sobretudo no livro “Eichmann em Jerusalém”.

With the emergence of a critical thinking in Law, there is an opening to other areas of knowledge, like Literature. Based on this, the proposition, in this article, is to analyze the possibilities brought by the jusliterary relation, considering that Literature has the potentiality of developing a critical thinking and an awareness in jurists. Therefore, it is based in the thinking of Brazilian researches André Karam Trindade e Lênio Streck, and in the relation between the literary work “The Reader”, of Bernhard Schlink, and Hannah Arendt’s legal philosophy, notably regarding the banality of evil, found, mainly, in the book “Eichmann in Jerusalem”.
