O presente trabalho trata sobre o processo de transgenitalização e as decisões judiciais acerca do tema. O artigo analisa esses julgados sob a perspectiva da Jurisdição Constitucional e da Análise Econômica do Direito. Inicialmente o trabalho trará de forma breve o tema da sexualidade. Após essas explanações, o texto tratará de forma sucinta as premissas da jurisdição constitucional e da Análise Econômica do Direito. Por fim, o trabalho analisará decisões judiciais sobre o processo de transgenitalização.
Resumo Inglês:
This paper deals with the process of transgendering and judicial decisions on the subject. It analyzes those judicial decisions from a Constitutional Jurisdiction and the Legal Economic Analysis perspective. Initially the work will briefly discuss the topic of sexuality and transgenderism. After these explanations, the text will succinctly deal with the premises of the constitutional jurisdiction and the Legal Economic Analysis. Finally, the paper will analyze judicial decisions about the process of transgendering.
