A recente decisão do Supremo Tribunal Federal na Ação Direta de Inconstitucionalidade por Omissão 26 e no Mandado de Injunção 4733, no sentido de declarar a mora do Poder Legislativo e aplicar, com efeitos prospectivos, até que o Congresso Nacional venha a legislar a respeito, a Lei 7.716/89, que define os crimes de preconceito de raça ou de cor, estendeu a tipificação prevista à discriminação por orientação sexual ou identidade de gênero, tendo criminalizado a homofobia.
Resumo Inglês:
The recent judgment of the Federal Supreme Court of Brazil in Direct Action of Unconstitutionality by Omission n. 26 and in “Mandado de Injunção” n. 4733 to declare the omission of the Legislative Power and apply, with prospective effects, up to the National Congress legislates on, Law n. 7.7716/89, which defines crimes of race or color prejudice to extend the envisaged typification to discrimination based on sexual orientation or gender identity. This decision criminalized homophobia.
