O presente artigo tem por escopo abordar sobre a polêmica teoria do jurista alemão Otto Bachof, que consignou a existência de normas constitucionais originárias inconstitucionais. Tal afirmação aparenta ser, em um primeiro momento, paradoxal, tendo a Corte Constitucional do Brasil apenas admitido a possibilidade de controle de constitucionalidade em relação às normas constitucionais derivadas. Nesse diapasão, o STF, ao apreciar a questão em relação às normas constitucionais originárias, salientou que haveria uma impossibilidade jurídica do pedido. Não obstante, a tese é aceita na Alemanha, reconhecendo-se uma hierarquia entre normas constitucionais originárias, tal hierarquia, por sua vez, é capaz de sustentar o controle de constitucionalidade sobre elas.

The purpose of this article is to discuss the controversial theory of the German jurist Otto Bachof, who consigned the existence of unconstitutional constitutional rules. Such a statement appears to be, at first, paradoxical, with the Brazilian Constitutional Court only admitting the possibility of constitutionality control in relation to the derived constitutional rules. In that pitch, the STF, when considering the issue in relation to the original constitutional rules, stressed that there would be a legal impossibility of the request. Nevertheless, the thesis is accepted in Germany, recognizing a hierarchy among original constitutional norms, such hierarchy, in turn, is capable of sustaining the constitutionality control over them.
