O presente trabalho analisa, ainda que brevemente, a tese fixada pelo Supremo Tribunal Federal após os embargos de declaração no Recurso Extraordinário 855.178 do Estado de Sergipe, sob o qual se discutiu a obrigatoriedade de um ente estatal superior cofinanciar o tratamento concedido pelo SUS no âmbito de ente estatal de competência mais reduzida.
