O artigo tem por objetivo analisar o direito à proteção de dados pessoais na era da internet em cotejo com a obra “1984”, de George Orwell, utilizada para ilustrar a vida em um mundo sem privacidade. Primeiramente, através de um paralelo entre a distopia orwelliana e a sociedade da informação, o texto busca refletir sobre os riscos do tratamento de dados pessoais na internet. Na sequência, perscruta sobre a evolução do direito à privacidade, bem como sobre o imperativo de se reconhecer a proteção de dados pessoais como um direito fundamental autônomo na Constituição Federal de 1988.
Resumo Inglês:
The article aims to analyze the right to personal data protection in the internet age relating to George Orwell’s book “1984”, used to illustrate life in a word without privacy. Firstly, through a parallel between orwellian dystopia and the information society, the text seeks to reflect about the risks of processing personal data on the internet. Following, it examines the evolution of the right to privacy as well as the imperative to recognize the protection of personal data as an autonomous fundamental right in the Federal Constitution of 1988.
