O sistema de contratações públicas é um dos principais pilares do Direito Administrativo. A partir dele, de forma imparcial, isonômica e com espeque nas regras preestabelecidas pelo legislador, o Poder Público adquire bens e serviços para atender às necessidades coletivas na prestação de serviços públicos. É um sistema rico em particularidades e em constante evolução, refletindo elementos subjacentes que dão a tônica da relação estabelecida entre a Administração Pública e o particular contratado. Nessa linha, este artigo se propõe a realizar um cotejo entre os ordenamentos jurídicos português e brasileiro, com o escopo de mostrar as principais convergências e divergências principiológicas. Para se chegar a esse fim, será utilizada como metodologia de investigação uma análise descritiva da doutrina e da legislação, percorrendo-se os principais aspectos do Código de Contratações de Portugal (CCP) e da Lei Geral de Licitações do Brasil, Lei Federal nº 8.666/1993.

The system of public contractions is one of the main pillars of Administrative Law. From it, in an impartial, isonomic way and with respect to the rules pre-established by the legislator, the Public Power provides to acquire goods and services to meet the collective needs in the provision of public services. It is a system rich in particularities and constantly evolving, reflecting underlying peculiarities that underline the relationship established between the Public Administration and the contracted private individual. Along this line, the purpose of this article will be to compare the Portuguese and Brazilian systems in order to show the main points of convergence and divergence. To achieve this, doctrine and legislation will be used as the research methodology, proceeding with a descriptive analysis of the main aspects of the Portuguese Contracting Code (CCP) and the General Bidding Law of Brazil, Federal Law nº 8.666/93.
