O presente artigo trata da dificuldade de compreensão das decisões
judiciais em virtude do excesso de tecnicismo na linguagem utilizada bem como no
descomedimento quando da fundamentação por parte do Magistrado, assim, faz-se
uma abordagem a partir do princÃpio constitucional da motivação e da Campanha pela
Simplificação da Linguagem JurÃdica promovida pela Associação dos Magistrados
Brasileiros. Discute-se conceitualmente o fenômeno da decisão judicial e sua
complexidade, buscando-se fundamentação no entendimento de alguns doutrinadores
e autores de análise do discurso e da linguagem.
Resumo Inglês:
The present article discusses the difficulty of understanding the court
rulings because of excessive technicality in the language used as well as in
immoderation by the reasoning of the Magistrate, so, it is an approach from the
constitutional principle of motivation and of the Campaign for Simplification of Legal
Language promoted by the Association of Brazilian Magistrates. It discusses
conceptually the phenomenon of court ruling and its complexity, searching for reasoning
on the understanding of some teachers and authors of discourse analysis and
language.
