Resumo Português:
Em primeiro lugar, o artigo analisa as convergências e complementaridades
das correntes garantistas e ativistas na aplicação da norma jurÃdica, deduzindo valores
axiológicos na concretização dos direitos humanos. Depois, examina os elementos que
permitem a concretização da norma constitucional que contenha direitos humanos. Por
fim, apresenta uma hermenêutica pautada em cinco aspectos fundamentais.

First, the article examines the similarities and complementarities among
activists ands garantists theories in applying the rule of law in domestic legal systems. It
examines the axiological values in the realization of human rights. Then examines the
elements that allow the achievement of the constitutional norm that contains human
rights. Finally, it presents a hermeneutics guided by five key aspects.
