Este artigo foi elaborado a partir do tema a função social da pena e o sistema penitenciário brasileiro, delimitando-se ao sistema penitenciário brasileiro. O estudo busca responder a questão problema: O atual sistema penitenciário brasileiro cumpre com o papel social da pena? Para tanto se partiu da hipótese de que a pena tem como fi nalidade intimidar potenciais criminosos, castigando e ressocializando os condenados, além de promover a segurança jurídica aos acusados e defesa social. A relevância para tal estudo reside na realidade, frequentemente noticiada nos meios de comunicação, do sistema prisional, de modo que, pesquisar, estudar e discutir aspectos relacionados com a pena e as prisões se mostra de interesse da sociedade em geral, que anseia por maior segurança. O objetivo geral deste estudo é verifi car se o sistema penitenciário brasileiro é capaz de promover a real função da pena. Buscando alcançar o objetivo traçado e responder a questão problema, realizou-se a presente pesquisa utilizando-se da técnica de pesquisa bibliográfica.

This article was elaborated from the theme the social function of the sentence and the Brazilian penitentiary system, delimiting itself to the Brazilian penitentiary system. The study seeks to answer the problem question: Does the current Brazilian penitentiary system fulfi ll the social role of punishment? For that, it was based on the hypothesis that the purpose of the penalty is to intimidate potential criminals, punishing and re-socializing the convicts, in addition to promoting legal security for the accused and social defense. The relevance of this study lies in the reality, often reported in the media, of the prison system, so that researching, studying and discussing aspects related to punishment and prisons is of interest to society in general, which yearns for greater security. The general objective of this study is to verify if the Brazilian penitentiary system is capable of promoting the real function of the penalty. Seeking to reach the outlined objective and answer the problem question, the present research was carried out using the bibliographical research technique.
