O presente artigo pretende examinar as implicações jurídicas e de saúde na eventualidade de se negar o direito ao esquecimento, mostrando a tríplice utilidade do instituto: na tutela da personalidade, na pacificação social e na promoção do bem-estar e saúde psíquica. Aborda o conceito, a evolução histórica e o tratamento que o instituto do Direito ao Esquecimento vem merecendo da jurisprudência brasileira e internacional.
Resumo Inglês:
This article aims to examine the legal and health implications in the event of denying the right to be let alone, showing the triple utility of the institute: in protecting the personality, in social pacification and in the promotion of well-being and mental health. The article addresses the concept, historical evolution and the treatment that the institute of the right to be let alone has been receiving from Brazilian and international jurisprudence.
